The petitioner seeks bail in Harlakhi P.S. case No. 122 of 2016 under Section 302 of the Indian Penal Code. The informant, wife of the deceased, alleged that on account of some previous dispute the petitioner pushed her husband, her husband fell down and got internal injuries. The learned counsel for the petitioner submits that no external or internal injury was found. The petitioner is alleged to have only pushed the husband of informant and he died. In the post mortem report, as it would appear from the order of the learned Additional Sessions Judge, cause of death is due to shock and hemorrhage.

It appears that petitioner simply pushed the deceased

Patna High Court Cr.Misc. No.14903 of 2017 (2) dt.20-04-2017 2/2 and he did not assault him in any manner.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Benipatti, Madhubani in Harlakhi P.S. Case No. 122 of 2016, G.R. No. 554 of 2016.
