2. Petitioner seeks regular bail in connection with Siwan Mufassil P.S. Case No. 740 of 2024 dated 22.11.2024 registered for the offences punishable under Sections 103 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The main submissions advanced by petitioner's counsel are that the informant is not an eyewitness to the alleged occurrence and claims to have reached the place of occurrence only after receiving information, where he allegedly found the dead body of his father. It is further submitted that the implication of the accused persons is solely based on a preexisting land dispute and alleged prior threats, without any

It is also submitted that no specific overt act has been attributed to the petitioner in the FIR, and the prosecution case rests on suspicion rather than concrete material and the petitioner has been falsely implicated due to enmity arising out of a land dispute, in respect of which T.S. No. 326/99 is pending between the parties. It is lastly submitted that the petitioner has been in custody since 19.04.2025.

4. Learned APP for the State has opposed the prayer for bail of the petitioner.

Considering the aforesaid submissions, and mainly taking into account the above-mentioned land dispute between the parties and the period of custody of the petitioner, this Court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Siwan Mufassil P.S. Case No. 740 of 2024.
