Mr. SIR PAWAN KUMAR CHAURASIYA ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-02-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Ekangar Sarai P.S. Case No. 150 of 2017 registered for the offence punishable under Sections 147, 149, 448, 308 and 379 of the Indian Penal Code.

The allegation is regarding scuffle having taken place in between the prosecution side and the accused side resulting in the members of both the sides receiving injuries. The learned counsel for the petitioner submits that while scuffle was taking place between the family members, the informant had gone to settle the matter whereafter it is alleged that the petitioner herein had also assaulted the informant side. It is further submitted that the present case arises out of a case

Patna High Court Cr.Misc. No.9854 of 2018(2) dt.19-02-2018 2/2 and counter case and the injuries sustained by the informant side is simple in nature while the injuries sustained by the petitioner's side is grievous in nature. The petitioner is stated to having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa (Nalanda) in connection with Ekangar Sarai P.S. Case No. 150 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
