The petitioner seeks bail in a case registered under Sections 363, 366(A)/34 of the Indian Penal Code and 4/6 of POCSO Act.

Prosecution case, in short, is that the accused persons kidnapped the daughter of the informant, namely, Nisha Kumari for the purpose of marriage.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.06.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The victim has been

Patna High Court CR. MISC. No.50312 of 2019(2) dt.14-08-2019 2/2 recovered. Her statement under Section 164 of Cr.P.C. has been recorded. She had left the house out of her own will and she got married with co-accused Suman Kumar. The petitioner has been made accused as he happens to be the relative of Suman Kumar. Except for this, there is no other substantive evidence to suggest his implication in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, East Champaran, Motihari in connection with Muffasil P.S. case No.264 of 2019.
