The petitioner apprehends his arrest in Riga P.S. Case No. 46/2015, registered for the offences punishable under Sections 302, 379, 34 of the Indian Penal Code and 27 of the Arms Act. The informant alleged that while his brother Dhirendra Kumar Singh had gone to Sitamarhi for purchasing medicine but he did not return, his nephew Bittu Singh and Shubham Kumar Singh went for search. The dead body of Dhirendra Kumar Singh was found near Usarhia Chowk.
It is submitted that the informant named the petitioner on suspicion only because the informant had altercation with the petitioner for damaging the wheat crops about 20 days ago. Except the suspicion, there appears that the investigating officer did not
Patna High Court Cr.Misc. No.28390 of 2015 (3) dt.12-10-2015 2/2 collect any other tangible material. The CDR of mobile of the petitioner was also taken but it has nowhere come that the petitioner, at the time of occurrence, was present on the place of occurrence.
Learned counsel for the informant as well as learned Additional P.P. vehemently opposed the prayer for anticipatory bail.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No. 46/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi/- U T
