The petitioner is accused in connection with Barari P.S. Case No. 298 of 2016, registered under Sections 302/34 and 120(B) of the Indian Penal Code.

The accusation is that, on 09.11.2016, Shiv Kumar Pandit, brother of the informant, had gone to village Jagdishpur for tuition of the children but he did not return. On next day, informant found the dead body of his brother in the maize field of Md. Taslim, sustaining slit injury on the neck. The informant raised suspicion against the petitioner having hand in the murder of his brother as there was love affair in between Tanuja Kumari, daughter of Akshay Lal Yadav and before six months marriage of

Patna High Court Cr.Misc. No.7068 of 2017 (2) dt.09-03-2017 Tanuja Kumari was performed with the son of the petitioner. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 24.11.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Katihar, in connection with Barari P.S.
