JUSTICE BIRENDRA KUMAR ORAL ORDER 21-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 461/379 of the Indian Penal Code.

The F.I.R. is against unknown. Name of the petitioner has transpired in the confessional statement of coaccused Rustam Dom. Nothing has been recovered from the possession of the petitioner.

Submission of the petitioner is that in para-3 of the bail petition the petitioner has disclosed criminal antecedent in all the cases the petitioner has been made accused on the basis of confessional statement of Rustam Dom.

No.12868 of 2017 (2) dt.21-03-2017 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada/Successor Court, in connection with Nawada Town P.S. Case No.799 of 2015, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
