Mr.Dayanand Singh, Advocate ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL JUDGMENT Date : 22-11-2024 The above cases are connected since in Request Case No. 49 of 2022, there was an Arbitrator appointed, who has now recused from the engagement. Request Case No. 96 of 2024 is filed by Respondent No. 3 in the other case for substitution of Arbitrator already appointed vide judgment dated 12.10.2022 passed in Request Case No. 49 of 2022.

2. On consent of both the parties, Dr. Ravi Ranjan, the former Hon'ble Chief Justice of Jharkhand High Court is appointed as the Arbitrator to adjudicate all disputes arising out of agreement entered into between the parties to the lis.

3. All pleas and issues raised, on merits, are left open to be considered and decided by the learned Arbitrator.

4. Learned Arbitrator shall be entitled to fee as per the schedule of the Act.

5. Since the dispute arises out of an agreement of the year 2007, the hearing be expedited.

6. Parties undertake to fully cooperate and not take any unnecessary adjournment.

7. The issue of limitation, if any, is left open to be raised before the learned Arbitrator.

8. Joint Registrar (List) is directed to communicate the order to the learned Arbitrator.

9. Learned counsel for the parties also undertake to communicate the order to the learned Arbitrator.

11. The Request Petitions stand disposed of in the above terms.
