Petitioner apprehends his arrest in connection with Parihar P.S. Case No.72 of 2016 for the offences registered under sections 376, 506, 34 of the Indian Penal Code and 4/8 POCSO Act.
There is specific allegation of gang rape against the petitioner and one co-accused and learned counsel appearing for the petitioner tried to convince me about the innocence of the petitioner on the ground that in medical examination, no sign of rape was found nor any semen was found on the person of the victim. Moreover, one co-accused was found admitted in hospital
Patna High Court Cr.Misc. No.40009 of 2016 (3) dt.19-11-2016 2/2 in course of investigation.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, I do not think it proper to grant privilege of anticipatory bail to the petitioner. Accordingly, his prayer for anticipatory bail in connection with Parihar P.S. Case No.72 of 2016 pending in the court of Chief Judicial Magistrate, Sitamarhi stands rejected.
