The petitioner has filed the instant application for grant of regular bail in connection with Bachhwara P.S. Case No. 135 of 2021 registered under sections 392 and 397 of the Indian Penal Code.

Allegation against the petitioner and other co-accused person is that they stopped the informant while he was coming from Teghra village and snatched his bike along with a bag in which some documents were there and fled away from there. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to village politics. It is further submitted that the petitioner is not named in F.I.R rather

Patna High Court CR. MISC. No.54342 of 2022(4) dt.20-02-2023 2/2 he has been remanded in this case on the basis of confessional statement of Vidyapati Nagar P.S. Case No. 77 of 2021 and also he has not been put on T.I.P. The alleged stolen motorcycle was recovered from the joint possession of the accused persons not from the conscious possession of the petitioner. He is languishing in judicial custody since 17.08.2021. The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Bachhwara P.S. Case No. 135 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Begusarai.
