2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363, 366(A) / 34 of the Indian Penal Code.

3. It is alleged that the petitioner in connivance with other co-accused persons eloped the minor daughter of the informant with mala fide intention.

4. Learned counsel for the petitioner submits that no such occurrence as alleged ever took place. Petitioner has been falsely implicated in this case. He submits that the petitioner has no criminal antecedent as mentioned in para - 3 of the bail application. The victim in her statement under Section 164 Cr.P.C. confessed that she has solemnized marriage with the

5. Learned APP for the State opposing prayer for anticipatory bail submits that the victim is minor.

6. Considering the facts and circumstances of the case and the fact that the victim is minor, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Madhepura P.S. Case No. 136 of 2023.

7. However, if the petitioner surrender before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order.
