Petitioners apprehend their arrest in N.T.P.C. P.S. Case No.25 of 2019, giving rise to Special Case No.3145 of 2019, registered under Sections 341, 323, 504, 354(B) and 34 of the Indian Penal Code and 37(c) of the Bihar Prohibition and Excise Act.

The prosecutrix alleged that Vivek Kumar @ Hagga came after having liquor and began to tease her. When she objected, Vivek Kumar assaulted the informant and her husband. When the informant and her husband objected, the petitioners, who are father, mother and brother of Vivek Kumar,

Patna High Court CR. MISC. No.51530 of 2019(2) dt.19-08-2019 2/2 are also alleged to have assaulted the informant. It appears that there is no allegation of teasing against the petitioners. The allegation of taking wine and teasing is against Vivek Kumar who is not the petitioner here. Considering the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with N.T.P.C. P.S. Case No.25 of 2019, giving rise to Special Case No.3145 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
