JUSTICE ARVIND SRIVASTAVA ORAL ORDER 17-02-2018 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Lakshmipur P.S. Case No. 168 of 2017 registered for the offence punishable under sections 323, 341, 302, 120B/34 of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that nothing specific has been alleged against these petitioners. They have been falsely implicated in this case at the instance of their agnates. Specific allegation has been levelled against co-accused Nilesh and Ritesh. From the allegations levelled, no case under section 302 I.P.C. is made out. Petitioners are men of clean antecedent.

Considering the facts and circumstances of the case and the
