In this case, the petitioner is questioning about the construction of the court in 1 + 5 on the point its height. He has raised grievance, by that height, it would hamper for landing and taking off the Aeroplane. He has further submitted that the

Patna High Court CWJC No.16130 of 2019(2) dt.26-08-2019 2/2 construction has been made without obtaining "No objection Certificate" from Saharsa Municipal Nagar Parishad. No any complain has been made that any portion of the land of the airport has been encroached upon. The construction of the court building is essential for running court in dispensing justice. It will be very difficult for the court to function in absence of court rooms. As submitted No Objection Certificate has not been taken, it may be irregularity, not illegality. If the petitioner feels aggrieved, he may raise issue before the appropriate authority. However, the Airport Authority if so like, may make suitable change.

Accordingly, this petition is disposed of.
