JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-11-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379 and 504/34 of the Indian Penal Code. The prosecution case is that due to ill health the informant was vomiting in the court-yard which was protested by one Ravi Roushan Singh. It is alleged that petitioner no.1 assaulted the informant causing injury on the left hand and when the mother of the informant Lalita Devi came to rescue then she was also assaulted by petitioner no.2 Bittu Singh, petitioner no.3 Chandra Bhushan Kumar, co-accused Rina Kumari and Saroj Devi. It is further alleged that petitioner no.2 Bittu Singh assaulted the younger brother of the informant with Khanti on his head.

No.51139 of 2015 (2) dt.09-11-2015 2/2 It is submitted by learned counsel for the petitioners that the petitioners are agnates of the informant and there is partition dispute pending between the parties. The injuries of the informant, informant's mother and younger brother have been found to be simple in nature. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad in connection with Obra P.S. Case No. 70 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
