JUSTICE BIRENDRA KUMAR ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 30(a)/37(b)(c) of the Bihar Excise (Amendment) Act, 2016.
From a vehicle country-made liquor was recovered and petitioner was also in the same vehicle. Submission is that petitioner has got no criminal antecedent and the recovered liquor was not of the petitioner. Petitioner is in custody since 20.12.2016.
Considering the entire facts and circumstances, let petitioner, above named, be enlarged on bail after completion of four months of custody on furnishing bail bond of Rs.10,000/-
Patna High Court Cr.Misc. No.8591 of 2017 (2) dt.01-03-2017 2/2 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad/Successor Court, in connection with Nabinagar P.S. Case No. 219 of 2016.
