The petitioners seek bail in K. Nagar (Maranga) P.S. Case No. 439/ 2016, registered for the offences punishable under Sections 302, 201 and 328/34 of the Indian Penal Code. The informant alleged that his son had gone to his Sasural, but the informant got information from his son on 30.11.2016 that his father-in-law, mother-in-law and wife were not allowing to bring his wife. On the next day, his son found dead. The petitioners, i.e. father-in-law, mother-in-law and wife of the deceased killed his son.
Learned counsel for the petitioners submits that there is no allegation against the petitioners. The Investigating Officer
Patna High Court Cr.Misc. No.12521 of 2017 (3) dt.17-04-2017 2/2 examined all the witnesses of the village of the informant, but there is no eye-witness of the occurrence. The Investigating Officer found the case true under Section 306 of the Indian Penal Code. No external injury was found on the person of the deceased. It is submitted that the deceased himself committed suicide as his wife was not intending to accompany him.
Considering the facts aforesaid and the fact that the petitioners are wife, mother-in-law and father-in-law of the deceased and after investigation it was found that the deceased himself committed suicide only because his wife did not intend to go with him, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Nagar (Maranga) P.S. Case No. 439/2016. (Prabhat Kumar Jha, J) Rakhi U
