JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 19-08-2016 The writ application is dismissed for the simple reason that engagement of the petitioner was by virtue of a policy so is the disengagement. Since the experiment as per the policy did not help achieve the objective, the State of Bihar decided to withdraw it and stopped its funding. The High Court is not a policy maker and cannot give a direction to the respondents to either continue or not continue with such schemes.
These are not permanent appointments under the State where the Court is required to issue mandamus.
