The petitioner seeks bail in Barh P.S. Case No. 185 of 2016 instituted for the offence under Section 392 of the Indian Penal Code.

It has been submitted that petitioner was not named in the written report. The name of the petitioner has come in the confessional statement of one Ravi Kumar who was arrested in connection with Ghoshwari P.S. Case No. 43 of 2016 and confessed before the police regarding involvement of the petitioner in this case and on the basis of said confessional statement, the petitioner was arrested in this case on 29.06.2016. It has further been submitted that other co-accused Samsi Imam

Patna High Court Cr.Misc. No.7290 of 2017 (2) dt.01-03-2017 2/2 whose name has been disclosed in the confessional statement of co-accused Ravi Kumar has already been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 44334 of 2016 on 14.12.2016.

In the facts and circumstances of the case, the prayer of the petitioner for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Barh, Patna in connection with Barh P.S. Case No. 185 of 2016, Sessions Trial No. 807 of 2016, subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Shageer/- U T
