1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 354, 504, 506 and 34 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and from perusal of the FIR, it would manifest that the date of occurrence is 07.02.2024 ant the FIR was instituted on 13.02.2024 i.e. after a delay of six days without any plausible explanation. It is also submitted that there is land dispute in between the parties and no specific allegation of assault is alleged against the petitioner

No.54338 of 2025(2) dt.21-08-2025 2/2 rather the allegation are general and omnibus in nature and the informant alleges that on 19.02.2025, all the accused persons including the petitioner came and assaulted him by butt of pistol causing injury on head and also assaulted his son with an iron rod and butt of pistol causing injury and snatched golden and silver chain of informant's daughter in-law. It is next submitted that petitioner is not a criminal.
4. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Salkhua P. S. Case No.46 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
