This application is for grant of anticipatory bail for the offence under Sections 420, 406, 467, 468 and 471/120B of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the only allegation against the petitioner is that he is son of the accused and power of attorney was shown to the informant in presence of the petitioner. It has further been submitted that the petitioner is in Army and now compromise has been reached between the parties.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts as

Patna High Court Cr.Misc. No.45516 of 2016 (2) dt.16-12-2016 2/2 stated above as well as the allegations that he was present at the spot when the power of attorney was shown to the informant apart from there is no allegation against the petitioner, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Muzaffarpur in connection with Sadar P.S.Case No.192 of 2013, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
