JUSTICE SANJAY PRIYA ORAL ORDER 01-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bakhtiyarpur (Kanaria O.P.) P.S. Case No. 385 of 2016 instituted for the offence under Sections 302, 201 and 34 of the Indian Penal Code. As per written report, one dead body of unknown person was found lying in water at Kathdumar Ghat and mouth and neck of the dead body was tied with plastic rope. Learned counsel appearing on behalf of father of the deceased has submitted that petitioner is wife of the deceased. She had illicit relationship with co-accused Md. Bablu. Case diary has been received.
Learned counsel appearing on behalf of father of the deceased has submitted that it is mentioned in the case diary that
Patna High Court Cr.Misc. No.9605 of 2017 (3) dt.01-05-2017 2/2 deceased died due to strangulation, and the witnesses have taken the name of this petitioner in the case diary. Learned A.P.P. has submitted that it is mentioned in the case diary that death occurred due to strangulation, but there is no any direct and specific overt act against the petitioner. The witnesses have merely raised suspicion against the petitioner. Petitioner is a lady. She is in custody since 9.11.2016. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bakhtiyarpur (Kanaria O.P.)
