ANJANA MISHRA ORAL ORDER 09-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Kharagpur P.S. Case No. 344/2017, registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that so far as the present petitioner is concerned, he has no connection with the sale and purchase of the land which was allegedly transacted between the parties. The only allegation is that he is one of the witnesses in the sale-deed and there is no element of conspiracy as has been alleged against the petitioner. It is further submitted that the two co-accused persons, namely, Sanjay Kumar @ Sanjay Yadav has since been extended the privilege of anticipatory bail in

Patna High Court Cr.Misc. No.16477 of 2018 (2) dt.09-04-2018 2/2 Cr. Misc. No. 9350 of 2018 dated 27.02.2018 and Dinesh Yadav has also been granted the said privilege in Cr. Misc. No. 9686 of 2018 vide order dated 26.03.2018.

Considering the aforementioned facts and circumstances and as stated the petitioner is not having any criminal antecedent, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Munger, in connection with Kharagpur P.S. Case No. 344/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
