The petitioner apprehends his arrest in a case under Sections 399, 403, 414 of the Indian Penal Code and Sections 25(1-b)A/26/35 of the Arms Act.
The police intercepted a vehicle and also arrested five persons from whose possession arms and ammunitions were recovered. The petitioner is not named in the F.I.R. The name of the petitioner figured in the case during the course of investigation only because the owner-book of the seized vehicle stands in the name of the petitioner. It is submitted that the petitioner has already executed a sale deed in favour of Murari Kumar, who was apprehended with the vehicle, but the registration of the sale deed could not be obtained.
Considering the facts aforesaid, the above named
Patna High Court Cr.Misc. No.31153 of 2015 (3) dt.12-10-2015 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in Balia P.S. Case No. 324 of 2014, corresponding to G.R. No. 4151/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
