JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 08-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.
The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 09.05.2014 passed in Cr. Misc. No. 5960 of 2014 and vide order dated 07.01.2016 passed in Cr. Misc. No. 42276 of 2015, on the ground that the petitioner is suffering in custody since 24.10.2013, the victim has already been examined but the trial has not been concluded as per amended proviso of Section 309 Cr.P.C.
Learned APP opposes the prayer of bail by submitting that the victim has supported the allegation of rape during her examination in the court also.
In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner,
Patna High Court Cr.Misc. No.9517 of 2017 (2) dt.08-03-2017 again his prayer for bail stands rejected.
However, learned trial court is directed to expedite the trial and conclude the same as early as possible, preferably within two moths from the date of receipt/production of a copy of this order, failing which the petitioner, if at no fault, may be at liberty to renew his prayer of bail.
