2. This application has been filed on behalf of the petitioner for quashing the order dated 14.06.2023 passed by the Circle Officer, Bihar Sharif, Nalanda.

3. The petitioner is given liberty to prefer an appeal against the final order passed under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 before the Collector, Nalanda within 30 days from today.

4. If such an appeal is filed along with a stay petition then the structure of the petitioner shall not be demolished till the stay application is taken up for hearing by the Collector.

5. The appeal shall be heard and decided by the Collector, Nalanda on merits, if the same is filed within the

Patna High Court CWJC No.12916 of 2023(4) dt.26-02-2024 2/2 aforesaid period i.e. within thirty days.

6. With the aforesaid directions, this application is disposed of.
