JUSTICE SANJAY PRIYA ORAL ORDER 21-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Misc. Case No. 109 of 2016 instituted for the offence under Section(s) 30(a) of the Bihar Excise (Amendment) Act, 2016.

It is alleged that total 68 litres of Nepali liquor has been recovered from the possession of this petitioner. The petitioner is said to be in custody since 19.11.2016.

It has been mentioned in para 3 of the petition that petitioner has no criminal antecedent.

Keeping in view the clean antecedent and the period spent in custody by the petitioner, prayer of the petitioner

Patna High Court Cr.Misc. No.11521 of 2017 (2) dt.21-03-2017 2/2 for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Misc. Case No. 109 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
