The petitioners have preferred this application for grant of regular bail in a case registered under sections 272, 273 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, on a raid being conducted the accused persons made an attempt to escape, however some of the accused persons including the two petitioners herein were caught and liquor was recovered from their possession. It is submitted by learned counsel for the petitioners that the petitioners who are ladies have been falsely implicated in the case. No incriminating article has been recovered from
Patna High Court CR. MISC. No.64640 of 2021(2) dt.10-03-2022 2/2 their possession. They have no criminal antecedent and are in custody since 19.9.2021. Charge sheet has been submitted in the case.
Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the petitioners not having any criminal antecedent and having remained in custody for more than 5 months, the Court directs the above two petitioners to be enlarged on bail in connection with Minapur P.S. case no. 342 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
