JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 457/380 of the Indian Penal Code.

The prosecution case is that two SIM installed in a duel mobile phone and cash of Rs. 1750/- were stolen from the house of the informant. The F.I.R was lodged against unknown. During investigation, on the basis of IMEI of mobile of the informant, it transpired that SIM of the petitioner was used in the mobile of the informant.

It is submitted by learned counsel for the petitioner that the alleged SIM was lost long back by the petitioner and intimation to that effect was given to the concerned mobile operator.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.51401 of 2015 (2) dt.10-11-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Industrial P.S. Case No. 21 of 2015, pending in the Court of learned Chief Judicial Magistrate, Bhagalpur. With the observations above, the application stands disposed off.
