JUSTICE SANJAY PRIYA ORAL ORDER 27-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 304(B)/34 of the Indian Penal Code.
The petitioner is husband of the deceased. There is allegation in the written report that the petitioner used to assault the deceased with belt and rod etc for demand of dowry. Case diary has been received. The victim girl (deceased) had stated before the police in paragraph-4 of the case diary before her death that the petitioner used to assault her with belt and lathi for demand of dowry.
The Sessions Judge has mentioned in the impugned order that the witnesses in paragraphs 12, 13, 14, 15 have
Patna High Court Cr.Misc. No.51318 of 2016 (3) dt.27-01-2017 2/2 supported the case of prosecution and leveled allegation against the petitioner.
Since there is direct and serious allegation against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
