This application for anticipatory bail arises out of Pakaribarawan P.S. Case No. 138 of 2019 for the offence under Sections 341, 323, 324, 325 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act and subsequently added Section 302 of the Indian Penal Code.

Considering the gravity of the offence and in the light of Supreme Court's decision in case of Jai Prakash Singh vs. State of Bihar and Others, reported in (2012) 4 SCC 379, I am not inclined to entertain this application for grant of anticipatory bail. This application is accordingly dismissed. The petitioners are directed to surrender before the Court below within a period of four weeks from today and seek

Patna High Court CR. MISC. No.51189 of 2019(2) dt.17-08-2019 2/2 regular bail, if so advised. If they do so, their application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
