The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 354(B) 354(D), 379, 323, 504, 506, 511 and 34 of the Indian Penal Code, Section 67 of the Information Technology Act and Section 37(b)(c) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioners submits that the petitioner nos. 1, 2 and 4 are persons with clean antecedent and petitioner no.3 has antecedent of one case and the informant alleges that on 12.04.2019 at about 7:30 PM while she along

No.54538 of 2022(2) dt.18-10-2022 2/3 with her brother was returning to their house from Aara, when on the way she went to buy some vegetables where Sanjeet and Vickey Singh caught the informant and took her in a dark place and molested her, it is next alleged that the informant raised alarm when her brother came but he was also abused and assaulted and his gold chain was snatched, it is further alleged that Sanjeet Singh in an intoxicated condition was apprehended by the local people and Rajkishore Singh managed to escape from the place of occurrence, it is next alleged that informant had friendship with Sanjeet Singh but she stopped talking to him after his marriage, but Sanjeet used to threatened her and her family member that he would not let her get married and would throw acid on her and also threatened to defame her by making her photo viral on Facebook.
Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, merely because they are related to Sanjeet Singh, it is next submitted that petitioner no.1 is father of Sanjeet Singh and petitioner no.4 is own brother of Sanjeet Singh while petitioner no.2 and 3 are cousin brothers of Sanjeet Singh. It is also submitted that from perusal of allegation as alleged in the FIR it would manifest that initially the informant alleges that she was

No.54538 of 2022(2) dt.18-10-2022 3/3 molested by Sanjeet and Vickey, but in the later part of the FIR she has alleged that Sanjeet was apprehended by local people and Rajkishore fled, but does mentioned about Vickey which also creates doubt with regard to the veracity of the allegations as alleged, it is next submitted that Sanjeet Kumar was apprehended and he has been granted regular bail by order dated 03.05.2019 in Excise Case No. 759 of 2019.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mahila P.S. Case No. 50 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
