JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioner apprehends his arrest in connection with Trial No. 3470 of 2017, arising out of Complaint Case No. 2198C of 2015 lodged for the offences under Sections 420 and 120B of the Indian Penal Code.

Allegation as per complaint petition is that complainant on assurance deposited Rs.5500/- in the company running by Vinod Prasad and when the amount was matured in the year 2010 he has not been given the maturity amount and thereafter Vinod Prasad has named this petitioner.

Submission of learned counsel for the petitioner is that the occurrence is of the year 2010 and after five years complaint petition was filed with respect to the occurrence and petitioner is

In the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, West Champaran, Bettiah, in connection with Trial No. 3470 of 2017, arising out of Complaint Case No. 2198C of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
