JUSTICE SANJAY PRIYA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 406 and 420/34 of the Indian Penal Code.

As per allegation in the written report, the informant purchased some jewellery from the jewellery shop of the petitioner which was later on found to be of sub-standard quality and when he requested to refund the same, the petitioner on one pretext or the other did not return. The informant went to the residence of petitioner at Patna where he was abused by the petitioner and his family members.

It has been submitted on behalf of the petitioner that the alleged shop is the joint family shop and due to family feud

The informant has mentioned in the written report the details of the jewelry alleged to have been supplied to him of substandard quality. There is no document filed by the informant in support of the purchase of these jewellery.

In such circumstances, let the petitioner in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Agamkuan P.S. Case No. 250 of 2014, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
