Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 420, 406, 498(A), 323, 494/34, 120(B) of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 15.07.2021, charge-sheet has been submitted and has antecedent of three cases.
The informant alleges that his daughter who is deaf and dumb by birth was married to the petitioner on 17.04.2016. Thereafter, the informant invested Rs.8,00,000 to Rs.10,00,000/-
Patna High Court CR. MISC. No.64205 of 2021(2) dt.31-03-2022 2/3 in the construction of the house of the in-laws of the victim. Further, after some time, the petitioner and his family member started demanding Rs.7,00,000/- by way of dowry and even ousted the victim from the house after getting all the ornaments. Further, the petitioner, on the eve of Holi, came and started demanding Rs.7,00,000/- and even assaulted his wife who was treated by the Doctor Poonam Singh. Further, the victim gave birth to a child who died. Further, the petitioner has performed his second marriage with Santoshi Kumari in August, 2019. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the status of the victim was much higher in comparison to the status of the petitioner, as such, there was adjustment problem which led to quarreling between the two and as a result of the same the victim on her own volition left her house and the petitioner is still ready and willing to keep his wife with him.
Learned counsel for the informant opposes the bail application and submits that the petitioner has performed second marriage with Santoshi Kumari and, as such, the question of keeping the victim now does not arise at this stage. Learned counsel for the petitioner seeks permission to

Permission is accorded.
