At an earlier occasion vide order dated 06.04.2011 the learned lower court had rejected the proposed amendment relating to adultery and the aforesaid order has not been challenged on account thereof, met with finality. That being so presence of so-called paramour Surendra Yadav is not at all necessary for the just decision of the case. Therefore, the learned lower court rightly refused the prayer made by the petitioner for addition of the party in terms of Order-I Rule-10 of the CPC. Instant petition lacks merit and is accordingly rejected. (Aditya Kumar Trivedi, J.) PN/- U
