JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-04-2017 The petitioner is in custody since 06.12.2016 in connection with Hajipur Sadar P.S. Case No. 471 of 2016, registered for offences punishable under Section 414 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that though there is allegation that petitioner was caught by the police with stolen motorcycle, however, there is nothing on record to show that the said motorcycle was a stolen one. Further petitioner has no criminal antecedent and he has sufficiently been punished for the said offence as he has been in judicial custody since 06.12.2016.

Having heard both sides, considering the facts and

No.17196 of 2017 (2) dt.13-04-2017 2/2 circumstances of the case, nature of allegation, period of custody and also that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, in connection with Hajipur Sadar P.S. Case No. 471 of 2016, with following conditions:- It is also clear that if the petitioner again found involved in any of such offence, in future, prosecution will be free to move for cancellation of his bail bonds.
