The petitioners, namely, Ramesh Mahaldar @ Bablu Mahaldar and Laxmi Mahaldar, apprehend their arrest in a case under Sections 447, 341, 323, 354, 504, 506/34 of the Indian Penal Code.
The informant made allegation that the petitioners and others assaulted him and his family members on account of land dispute. It is submitted that the petitioners are own brother and nephew of the informant. On account of land dispute, some altercation took place and, for that, the informant filed this case making false and frivolous allegation. From the side of the petitioners, a complaint case is filed.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the
Patna High Court Cr.Misc. No.50343 of 2015 (3) dt.04-01-2016 2/2 learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in K. Nagar P.S. Case No. 408/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
