The petitioner is languishing in jail since 12.12.2016 in connection with Ekma P. S. Case No. 210 of 2016 for offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30/38/41 of the Bihar Prohibition and Excise (Amendment) Act, 2016.
The prosecution case as lodged by the police personnel is that on secret tip off the house of the petitioner's husband Parashuram Chaudhary was searched and 14 liters of Mahua liquor was seized. Wife, who is the petitioner, was absconding but it is alleged that she along with the husband prepared illegal Mahua wine. Accordingly the seizure list was prepared.
It has been submitted by the learned counsel for
Patna High Court Cr.Misc. No.6455 of 2017 (2) dt.20-02-2017 2/2 the petitioner that she is innocent and has been falsely implicated in the aforesaid case. It is also submitted that nothing has been recovered from the conscious possession of the petitioner and has no criminal antecedent as stated in para-3 of this petition. However, learned A. P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Divya Prakash, Ist class, Judicial Magistrate, Saran at Chapra in connection with Ekma P. S.
