ANJANA MISHRA ORAL ORDER 11-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Amnour P.S. Case No. 93/2017 registered for the offences punishable under Sections 135 of the Electricity Act. Learned counsel for the petitioner submits some factually incorrect bills have been served on him which was duly protested by the petitioner. It is submitted that on protest having been made by the petitioner, he has been implicated in the present case. He further submits that till date he is paying his bills in time and, if at all, there was any discrepancy, the Electricity Department can well have the same verified and proper report be submitted in connection with such an act. He next submits that at
Patna High Court Cr.Misc. No.16706 of 2018 (2) dt.11-04-2018 2/2 all possible time, he is willing to co-operate with the North Bihar Power Distribution Company Limited for rectification/correction of bills and also to make payments whatsoever is considered to be the correct amount.
Considering the aforementioned facts and circumstances of the case and that the petitioner is willing to cooperate and make whatever payments are due from him, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned A.C.J.M.-5th, Saran at Chapra, in connection with Amnour P.S. Case No. 93/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
