ANJANA MISHRA ORAL ORDER 13-10-2015 Heard learned counsel for the petitioners and learned A.P.P. appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Sangrampur P.S. Case No.14 of 2014 registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner Nos. 1 and 2 are the mother-in-law and sister-in-law of the deceased, who died under suspicious circumstances. Petitioner No.3 is the elder brother of the husband. It is further submitted that similarly situated co-accused, namely, Prity Devi, has been extended the privilege of anticipatory bail by a Bench of this Court in Cr. Misc. No.30124 of 2014 vide order dated 06.07.2015.

No.29919 of 2015 (3) dt.13-10-2015 Considering the aforementioned facts and the petitioners are similarly situated, let the petitioners, above named, in the event of their arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Sangrampur P.S. Case No.14 of 2014, subject to the conditions as laid down under Section 438 of the Code of Criminal Procedure with following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.

(ii) As soon as the charges are framed the petitioner shall appear in person before the trial court on the date (s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial court shall have liberty to cancel the bail bonds of the petitioner and seccure their arrest in accordance with law.
