JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Heard learned counsels for the petitioners and the State.
The petitioners are apprehending arrest in a case registered for the offences punishable under
Patna High Court Cr.Misc. No.41960 of 2015 (2) dt.13-10-2015 2/3 sections 420,467, 468 and 471 of the Indian Penal Code.
The prosecution case is that the petitioners got selected on the post of ANM in the hospital on the basis of forged Nursing Certificate. It is submitted by the learned counsel for the petitioners that the petitioners were not actually appointed on the basis of said certificates and the certificates were issued by the Bihar Registration Nurses Council, Patna.
Considering the fact that the case was instituted in 2011 and the present application has been filed in 2015, this court is not inclined to grant anticipatory bail to the petitioners after four years but since the petitioners have actually not been appointed on the basis of forged certificates and they are ladies, it is a case for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with K. Hat P.S. Case No. 448 of 2011 pending in the court of learned CJM, Purnea.
This application is disposed of with the
Patna High Court Cr.Misc. No.41960 of 2015 (2) dt.13-10-2015 3/3 aforesaid observation/direction.
