2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 354, 385/34 of the Indian Penal Code.
3. As per prosecution case, all the F.I.R. named accused persons assaulted son of the informant as a result of which he sustained head injury.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is not named in the F.I.R. and his name transpired during course of investigation. There is no allegation of assault against the petitioner and he has been made accused only on suspicion. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed

Considering the backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Madhepura in connection with Kumar Khand P. S. Case No. 161 of 2023, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
