JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 21-12-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in a case under section 307/34 and other allied sections of the Indian Penal Code. It is alleged that one Madan Chaudhary sprinkled petrol on Sunny Kumar and the petitioner along with Rajni Kumari set fire on account of which the former got badly injured. It is further alleged that the accused persons entered the house and committed theft.
Learned counsel for the petitioner submits that the case of the petitioner is similar to that of Rajni Kumari who has been granted anticipatory bail by the learned court below. He further submits that there is a case and counter case between the parties. Having regard to the facts and circumstances of the case, if
Patna High Court Cr.Misc. No.50077 of 2015 (3) dt.21-12-2015 the petitioner surrenders before the court below within four weeks from today and if the learned Magistrate, in seisin of the case, finds that the allegation against the petitioner vis-a-viz Rajni Kumari is similar, she too would be enlarged on bail on furnishing bail bonds to the satisfaction of the court concerned. With the aforesaid observations and directions, this application stands disposed of.
