JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420 of the Indian Penal Code.
As per the prosecution case, the petitioner has taken Rs. 1, 50,000/- as advance from the complainant to sell a particular piece of land. Later on the complainant came to know that land in question does not belong to the petitioner and when the complainant asked to return the amount the petitioner refused to return the same.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the
Patna High Court CR. MISC. No.65520 of 2021(3) dt.04-08-2022 2/2 case. No money as advance was given to this petitioner as in support of the allegation no chit of paper has been annexed by the complainant.
Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case and nature of accusation against the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Kaimur at Bhabua in connection with Complaint case No. 782/ 2020, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
