JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and, earlier, his prayer for bail was rejected by this Court but submission on behalf of the petitioner is that petitioner is in jail custody for more then two years but uptil now, his trial has not been concluded.
The report of the 4th Additional sessions Judge, Bhagalpur, goes to show that out of 15 proposed prosecution witnesses, 13 prosecution witnesses have already been examined. The aforesaid report suggests that the trial of the petitioner is on the verge of conclusion and, therefore, again, I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Session trial no. 320 of 2016, arising out of
Patna High Court Cr.Misc. No.6903 of 2017 (3) dt.29-03-2017 2/2 Budhu Chak P.S.Case No. 30 of 2015, pending in the court of 4th Additional Session Judge, Bhagalpur, stands rejected. However, the learned trial court should conclude the trial of the petitioner within four months from the date of receipt/ production of a copy of this order. It is made clear that if the trial court fails to conclude the trial of the petitioner within the above stated period on the latches of prosecution, the petitioner may renew his prayer for bail before the learned trial court itself.
