Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Mojahidpur (Babarganj) P.S. Case No. 257 of 2021, registered for the offences punishable under Sections 392 of the Indian Penal Code.

As per allegation, when the informant was returning to his house, the petitioner along with other co-accused persons snatched his mobile and golden ring at the point of pistol and when the informant opposed, they badly assaulted him. Learned counsel for the petitioner has submitted that

No.54374 of 2022(2) dt.24-01-2023 2/2 the petitioner is innocent and has falsely been implicated merely because one week prior to lodging of this FIR, brother of the petitioner has lodged a case against the prosecution side as the accused persons had badly assaulted him and due to that vendetta he has falsely been implicated in this case. Considering the above-mentioned facts and circumstances and also considering the clean antecedent of the petitioner, let him, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned P. Chandra, J.M. 1st Class, Bhagalpur in connection with Mojahidpur (Babarganj) P.S. Case No. 257 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
