Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner apprehends his arrest in connection with Dariapur P.S. Case no. 449 of 2020 registered under section 307 and other allied section of the Indian Penal Code. The main submission advanced by the learned counsel for the petitioner is that as per allegation made in the FIR, petitioner is alleged to have assaulted the injured person namely, Umesh Giri at his hand by means of lathi except this there is no any other allegation against the petitioner. After completion of investigation, police submitted charge sheet under bailable

No.64170 of 2021(2) dt.16-06-2022 2/2 offence and enmity between the parties is admitted and two named co-accused persons, namely, Ranjay Giri and Ajay Giri have been granted regular bail by a coordinate bench of this court vide order dated 31.3.2022 passed in Cr. Misc. no. 64764 of 2021.

Learned APP opposes the prayer for anticipatory bail. Having considered the above submissions and the allegation levelled against the petitioner in the FIR, let the above named petitioner, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate XIII, Saran at Chapra in connection with Dariapur P.S. Case no. 449 of 2020 subject to condition as laid down under section 438(2) Cr.P.C.
