The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Bidupur P.S. Case No. 386 of 2025, lodged on 07.06.2025, under Section 309(4) of the Bhartiya Nyay Sanhita, 2023.

3. As per the prosecution, FIR is lodged against three unknown accused persons against whom allegation of loot is there.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that antecedent of the petitioner is not clean and there are four criminal cases pending against the petitioner. Counsel submits that name of the petitioner has not figured in the FIR; rather his name has come only by virtue of confessional statement of co-accused. Counsel submits that nothing has been recovered from the possession of the petitioner and save and except confessional statement there is nothing against the petitioner.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that it is true that name of the petitioner has come by virtue of confessional statement of coaccused but the said confessional statement is not only confession rather it is corroboration also. He submits that in the rejection order it has been categorically indicated that on the confessional statement of the petitioner the looted amount, mobile phone set has been recovered, which was subject to loot has been recovered. He submits that antecedent of the petitioner is not clean and there are four criminal antecedents against the petitioner.

6. In that view of the matter, this Court is not inclined
