The petitioner apprehends his arrest in a case registered for offences punishable under Sections 279, 354, 366, 366A and 511 of the Indian Penal Code.
Learned counsel for the petitioner submits that the informant has filed this case only to save her reputation in the society as she had gone with the accused persons on the vehicle for joy riding but when they were spotted by the villagers, she has manipulated this false and frivolous case against the petitioner. The petitioner is the driver of the said vehicle and has no concern with the accused. So far allegation of misbehavior is concerned, i.e., against other co-accused persons. It is also contended that no
Patna High Court Cr.Misc. No.37803 of 2016 (2) dt.17-09-2016 2 / 2 offence under Section 366 of the I.P.C. is made out and his antecedent is clean.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Dawath P.S. Case No. 30 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Bikramganj, Rohtas subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure (Dr. Ravi Ranjan, J) Sanjay-II/- U T
